Domestic Battery is one of the most sensitive charges a person can face. The highly-charged emotions that accompany all parties to an alleged incident of domestic violence are difficult to face for many people. Domestic Battery is sometimes called Domestic Assault, Domestic Violence, or Domestic Abuse. However, under the laws of the State of Illinois, it is called Domestic Battery.
Being accused of Domestic Battery carries a stigma that is not shared with many other criminal charges. The charge can often be accompanied with an Order of Protection or Juvenile proceedings where child custody could be lost to the foster care system. Domestic Battery, or other allegations of domestic violence, is not a charge you want to leave to chance on the hope that everything will simply turn out fine on its own.
Domestic Battery is usually charged as a Class A misdemeanor. Class A misdemeanors carry a possible sentence of up to 1 year, or 364 days, in the county jail.
Domestic Battery can also be charged as a Class 4 felony if it is the second or subsequent time a person has been charged with Domestic Battery. Class 4 felonies carry a possible sentence of up to 3 years in prison. This 3 year sentence in the Department of Corrections can be extended up to 6 years if a person has a prior felony on their record.
Some cases of Domestic Battery can be charged as Aggravated Domestic Battery. Aggravated Domestic Battery is a Class 2 felony. Class 2 felonies carry a possible sentence of up to 7 years in prison. This 7 year sentence in the Department of Corrections can be extended up to 14 years if a person has a prior felony on their record that is a Class 2 felony or higher (Class 2, Class 1, Class X, or Murder).
A conviction for Domestic Battery can also result in the loss of your right to own or carry a firearm. A Domestic Battery conviction can also cause you to lose your job and disqualify you from certain other jobs and occupations. The consequences of a Domestic Battery conviction are much more far-reaching than many people ever imagine.
